Design Guidelines Manual for the Boca Grande Historic District in Lee
County, Florida Rehabilitation of Historic Buildings, New Construction and
Remodeling of Non-Historic Buildings, June 1993 and Chapter 22 of the Lee
County Land Development Code.

Lee County Administrative Code 13-3 adopted on June 26, 2001, entitled
“Administrative Procedures Governing Community Planning Efforts Receiving
Financial Support from the Board of County Commissioners.”

Lee County Resolution Number 05-06-55 adopted on June 28, 2005
amending Lee County Administrative Code 13-3.

Lee County Community Planning Proposal submitted by Morris-Depew
Associates, Inc. on March 3, 2004 to Mr. Paul O'Connor,
Director, Lee County Division of Planning pursuant to Section 2.2
of Lee County Administrative Code 13-3. This Proposal was
determined to be sufficient by the Division of Planning Staff and
was a prerequisite to obtaining approval of the Community
Planning Agreement by the County Commissioners (see the
next document below). Attached to the Proposal is a Proposed
Timetable and a Proposed Budget for the Community
Plan. Certain documentation submitted with the Proposal is
included elsewhere on this Website and is not attached to the
Proposal. Copies of the aerial photographs and maps submitted
with the Proposal are included below after the Interlocal Agreement
between Charlotte County and Lee County.

Community Planning Agreement between Boca Grande
Community Planning Association, Inc. and the Lee County Board
of County Commissioners entered into pursuant to Section 3 of
Lee County Administrative Code 13-3 and providing for the grant
of $25,000 by Lee County for the community planning effort.
Exhibits A and B showing the geographic area covered by the Agreement
and a detailed descriptive of items required to be delivered by the Community
Planning Panel under the Agreement are attached. Exhibit C to the Agreement
is Lee County Administrative Code 13-3 as adopted June 26, 2001 and is
not attached because it is included under this Section X above. The
Agreement was approved by the Lee County Board of County Commissioners
at a meeting on Tuesday, April 13, 2004.

Second Community Planning Agreement between Boca Grande
Community Planning Association, Inc. and the Lee County Commissioners
entered into pursuant to Section 4 of Lee County Administrative Code 13-3,
as amended on June 28, 2005, and providing for the grant of $50,000 by Lee
County for the preparation of land development regulations necessary to
implement the Lee County Vision Statement and Lee County Goal, Objectives
and Policies for Boca Grande adopted at the Adoption Hearing on October 12,
2005 for inclusion in the Lee County Comprehensive Plan. Exhibit A shows
the geographic area covered by the Agreement and Exhibit B is a copy of
the February 1, 2006 implementation funding request submitted to Lee County
(see second bulleted item under Section VII above). Exhibit C to the Agreement is
Lee County Administrative Code 13-3, as amended on June 28, 2005, and is
not attached because it is included under this Section X above. The Agreement was
approved by the Lee County Board of County Commissioners at a meeting on Tuesday,
April 4, 2006.

First Amendment to the Community Planning Agreement between Lee County
and Boca Grande Community Planning Association, Inc. regarding Land Development
Code Regulations (previously referred to as the Second Community Planning
Agreement) entered into to provide an extension of the deliverables date to December
2009. The Exhibits are not attached because they are the same as the Exhibits to the
preceding bulleted item. The First Amendment was approved by the Lee County Board
of County Commissioners on Tuesday, March 11, 2008.

Charlotte County Community Planning Proposal dated April 2, 2004
submitted by Morris-Depew Associates, Inc. to Mac V. Horton, Charlotte
County Commissioner. Note: Unlike Lee County, Charlotte County does not
have a formal procedure for a community planning effort but a number
of communities in Charlotte County have adopted or are in the process of
adopting community plans. The proposal to Charlotte County sought a grant of
$20,000 from Charlotte County for the community planning effort. The
Charlotte County proposal includes the same Proposed Timetable for the
adoption of the Community Plan, the same Proposed Budget for the
Community Plan and the same aerial photographs and maps as were
included in the Community Planning Proposal submitted to Lee County.
The aerial photographs and maps are included below under the Interlocal
Agreement between Charlotte County and Lee County.

Note: On Tuesday June 22, 2004, the Charlotte County Board of County
Commissioners approved a grant of $20,000 for the community planning
effort and directed the Attorney's Office to draft an Interlocal Agreement
(see the following item) for the transfer of the $20,000 to Lee County
for the completion of the Joint Lee/Charlotte County Boca Grande
Community Plan.

Interlocal Agreement between Charlotte County and Lee County for transfer
of funds for completion of Joint Lee/Charlotte County Boca Grande Community
Plan. The Interlocal Agreement was approved by the Lee County Board of
County Commissioners on December 21, 2004.

    Miscellaneous Memoranda.

  • Memorandum prepared by John Subak dated February 19, 2004
    regarding various alternatives relating to prohibiting or regulating
    so-called formula or franchise restaurants in the Community Plan.
    This memorandum was prepared at the request of Bill Heisel. The
    formula or franchise restaurant issue was discussed at a number of
    Subcommittee and Panel meetings.

  • Memoradum prepared by Don Josephs dated February 9, 2004
    regarding establishing a Document Clearing House on Boca Grande
    and related spreadsheet. This memorandum was prepared at the request
    of Bill Heisel. The Document Clearing House issue was discussed at
    a number of Subcommittee and Panel meetings.
